Appeal by the defendant, Irving Euland, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 30th day of June, 1915, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 3d day of July, 1915, denying defendant’s motion for a new trial made upon the minutes.

Scott, J.:
In the year 1913 a corporation known as the Forty-first Street Eealty Company, of which defendant was a stockholder and the vice-president, was engaged in renovating a building at Forty-first street and Broadway in the city of New York. The property was incumbered by a large purchase-money first mortgage, and reliance seems to have been had upon a second mortgage to raise the funds necessary to be used in the work of renovation.
