It may be understood that, of the identified defendants, those named as, “the Court of Condemnation, composed of Cloyde B. Ellis, Fay H. Pollock and Edmund Nuss,” have taken no active part in this proceeding, and filed no pleadings herein, in relation to the controversy upon which ruling is being announced.
