SARIS, District Judge.
I. INTRODUCTION
Plaintiff, David M. O’Neil claims that he was terminated from his job at defendant, Putnam Retail Management Limited Partnership (“Putnam”), because of discrimination based on his status as a member of the United States Navy Reserves, in violation of the Uniformed Services Employment and Re-employment Rights Act (“USERRA”), 38 U.S.C. § 4301 et seq.
