Gallagher, Chief Justice.
Plaintiff had a verdict for damages to his automobile resulting from a collision with defendant’s bus. The appeal is from an order denying defendant’s motion for judgment notwithstanding the verdict or a new trial.
The collision occurred about eight o’clock on the night of January 4, 1936, about three miles north of Zimmerman on highway No. 169. At this point the highway lies north and south,.the pavement being 20 feet wide with ten-foot shoulders on each side. The night was cloudy, dark, and cold, and the pavement somewhat icy and slippery. . .
