Plaintiff, the administratrix of the estate of Arthur Hayungs, deceased, brought an action against the defendant, Conrad Falk, claiming negligence by him which resulted in a truck-automobile collision and the wrongful death of her husband. Harry Barth, the owner of the truck involved, sought recovery against the defendant for damages to the truck. Falk counterclaimed in both actions and the court, upon motion, consolidated the two cases.
