¶ 1. We review a published decision of the court of appeals, 1 which reversed the circuit court's 2 dismissal of the criminal complaint and information filed against Brian S. Kempainen ("Kempainen"). On December 21, 2012, the Sheboygan County District Attorney's Office filed a criminal complaint alleging Kempainen had engaged in two counts of sexual assault of a child under 13 years of age, contrary to Wis.
