THIS CAUSE comes before the Court upon Defendant’s Motion for Summary Judgment.

Background

On September 2, 1997, post office employee, Jesus Antonio Tamayo, while on post office property, shot Manuela Acosta (his ex-wife) and Mirna Mendoza (his ex-wife’s friend), and then committed suicide. Ms. Mendoza died on December 22, 1997.
