Appeal from a judgment of the County Court of Schenectady County (Stroebel, Jr., J.), rendered August 1, 1983, upon a verdict convicting defendant of the crimes of rape in the first degree, assault in the second degree and unlawful imprisonment in the first degree.

Defendant was convicted for crimes arising out of his attack on a 16-year-old girl he had accosted on her way to Mount Pleasant High School in the City of Schenectady at about 7:00 a.m. on May 6, 1982.
