Plaintiff brings this suit as adminis-tratrix of the estate of her deceased son who was instantly killed by a street car operated by defendant city on Clairmount avenue. The boy was four years and three months old. The declaration counts under the death act. At the close of plaintiff’s proofs and at the close of all the proofs, defendant asked for a. directed verdict and the question was reserved under the Empson act.
