We take from appellees’ brief the following statement of the nature .of the case: “Appellant brought this suit in the district court of the Fourteenth judicial district of Dallas county against the-appellees and J. P. Murphy and Charles F. Bolanz. His original petition was filed July 25, 1905. Appellant sued the appellees A. B.
