This case presents the issue of whether, under the facts, an employer is liable for indemnification to an employee who has caused injuries to, and has subsequently been sued by, a co-employee.

Richard Alan Leonard, the appellee, was employed by the appellant Sav-A-Stop Services, Incorporated, which was engaged in the business of maintaining and servicing retail sales outlets. Leonard’s duties were to call on these sales outlets, and, as part of his employment, he was required to drive a truck furnished by Sav-A-Stop.
