This case is in this court upon the grant of a certiorari to review the decision in Latimer v. Bennett, 37 Ga. App. 246 (139 S. E. 570).
The first assignment of error upon the judgment of the Court of Appeals, affirming the judgment of the court below in the main bill of exceptions, is that that court erred in holding that “Section 8 of the act of 1888 (Ga.
