The appellant was informed against for the crime of murder in the first degree, tried, and found guilty by a jury. Sentence was pronounced upon the verdict on the 15th day of April, 1901, at which time the appellant gave notice of appeal to this court. On August 30, 1901, the respondent filed a short record in this court showing the trial, verdict, judgment, and sentence, notice of appeal, and that the appeal had not been perfected within the time prescribed hy law, and moved for its dismissal.
