The respondent moves to strike the statement of facts in this case because it was not served within *165ninety days from the day of the rendition of the judgment. Final judgment was entered on the 9th day of March, .1894, and the time for appeal commenced to run oh that date. The statement of facts was filed and served on the 8th day of June, 1894.
