ORDER DISMISSING INVOLUNTARY PETITION

This Court conducted the trial on the involuntary petition in this case on September 22, 2005. 1 The facts reflect that this involuntary case is essentially a two-party dispute. There is only one petitioning creditor, DHL Aero Expresso, S.A., a Panamanian cargo carrier which chartered an airplane for use by the alleged debtor. DHL claims that it is owed approximately $400,000 by the alleged debtor, which it contends has fewer than 12 creditors for purposes of 11 U.S.C. § 303(b)(2). During the trial, the petitioning…
