ORDER AFFIRMING BANKRUPTCY COURT’S ORDER

MORENO, District Judge.

Appellant Remex Electronics Limited petitioned the Bankruptcy Court to have ap-pellee Axl Industries, Inc. declared bankrupt. Axl filed a motion to dismiss the involuntary petition, which was denied without prejudice. Axl subsequently renewed the motion and an evidentiary hearing was held on the renewed motion. On August 16, 1990, after hearing testimony of several witnesses and argument of counsel, Judge Donald granted the motion dismissing Remex’s petition pursuant to 11 U.S.C. §§ 305(a)(1), 303(b)(1), and (h)(1), finding that…
