This suit was originally filed in the district court of Hutchinson county, on January 26, 1928, by John Q. Bost and his wife, as plaintiffs, against the Tyler Oil Corporation, M. F. Woods, and Margie Edgar, as defendants. By agreement of the parties, the case was transferred to the district court of Potter county. On trial before the court without a jury, judgment was rendered for the plaintiffs, and defendants Edgar and Woods have appealed to this court.
