Involved in this appeal are two cases which were consolidated for trial in Suffolk County and, by order of a single justice of this court, consolidated here for the purposes of briefing and argument. The first of the two cases is a tort action brought in the Superior Court in Bristol County by Domingos Samagaio (Samagaio) against his employer, Herbert W. Davidson, Jr. (Davidson), for personal injuries sustained in the course of his employment for which he alleges Davidson is liable as an uninsured employer required by G.
