MEMORANDUM OPINION
SCOTT, District Judge.
This Cause is before the Court upon the parties’ cross-motions for summary judgment, filed pursuant to Rule 56 of the Federal Rules of Civil Procedure, and stipulation of facts. The plaintiffs, as Trustees of the Laborers Health and Welfare Trust Fund of South Florida, (“Trust Fund”), have instituted this action pursuant to Sec tion 502(a)(3)(B) of the Employee Retirement Income Security Act of 1974, as amended (“ERISA”), 29 U.S.C. § 1132(a)(3)(B).
