This case arises out of a personal injury sustained by a young child on an escalator operated by the Washington Metropolitan Area Transit Authority (“WMATA”). The plaintiffs’ case rested on the doctrine of res ipsa loquitur, but the District Court concluded that they could not establish facts sufficient to permit a jury verdict for them based on that theory.
