Appeal from a judgment of the Supreme Court, rendered January 28, 1907, at a Trial Term for the county of Oneida upon a verdict convicting the defendant of the crime of murder in the first degree. The facts, so far as material, are stated in the opinion.

Willard Bartlett, J.:

The indictment in this case charged the defendant with the crime of murder in the first degree committed at the city of Rome, in Oneida, county, on the 30th day of June, 1906, upon the body of one Tony Page by means of a knife, with which a fatal stab wound was inflicted in the abdomen, causing the death of the victim on the following day. The defendant pleaded not guilty and testified as a witness in his own behalf,, denying the infliction by him of any stab wound whatever upon the body of the deceased and giving evidence which, if it had been believed by the jury,,…
