BATEMAN, Justice.

The appellant North Texas Lumber Company sued Charles L. Sherwood, Jr. and Henry N. Kaspar for debt, alleging that the defendants were partners or joint ven-turers trading as Postscript Homes or, alternatively, that they were estopped to deny that they were liable as partners or joint venturers. Appellant also sued for an attorney’s fee pursuant to Vernon’s Ann.Civ.St, Art. 2226.
