OPINION

YOUNG, Justice.

This is an appeal from the granting of an instructed verdict. Gene Guynn (Guynn) d/b/a S & J Specialty Company (S & J) and his partner Ed Hodges (Hodges), appellants, brought suit against Corpus Christi Bank & Trust (Bank); Coastal Tubular Sales, Inc. (Coastal); Jack Trice, individually (Trice); Japan Cotton Company (Japan); Pete Sub-lett & Company, Inc. (Sublett); and Nichi-men Company Ltd.
