This is a suit for personal injuries alleged to have been sustained by ap-pellee, Van Zandt Smith, through a collision between one of the appellant’s cars and the automobile, which plaintiff’s' brother, Walter D. Smith, was driving, and in which plaintiff and some ladies were riding. The collision occurred at the intersection of Main and Eleventh streets in the city of Ft. Worth, September 12,1917, between 10 and 11 o’clock at night. The only ground of negligence alleged was that the car was running at an unlawful speed, in violation of section 57 of the ordinances of the city of Ft. Worth.…
