RAKOFF, District Judge.
The Complaint herein alleges employment discrimination under Title VII of the Civil Rights Act of 1964, under 42 U.S.C. § 1981, and under the New York State and New York City Human Rights Laws. Shortly after commencement of the action, defendant moved to dismiss. 1 On August 31, 1999, the Honorable Ronald L. Ellis, United States Magistrate Judge, issued a Report and Recommendation (the “Report”) recommending dismissal of those of plaintiffs Title VII claims as allege discriminatory discharge and retaliatory discharge, but otherwise denying the motion.…
