I. PROCEDURAL AND FACTUAL HISTORY
Dewitt Webster (“Webster”) was terminated from his position with Milwaukee County as a Highway Maintenance Worker I on September 26, 2006. (Docket No. 22 at 2.) This termination was the culmina tion of a lengthy progressive discipline against Webster for what the Milwaukee County Personnel Review Board (“PRB”) determined were his repeated failures to comply with the County’s attendance policy.
