This suit was commenced by appellee against appellant to recover the value of a horse killed by one of appellee’s freight trains within the limits of the village of Foosland. It appears from the evidence that as the train approached the village the whistle upon the engine was sounded at the usual place, but, there being no occasion for the train to stop at that point, it continued on its way through the village at the rate of from twelve to fifteen miles per hour. Witnesses who saw the horse killed say they heard no bell, but the fireman says lie rang the bell all the way through the village…
