OPINION

BUSSEY, Presiding Judge:

Appellant, William Dee Ellis, hereinafter referred to as defendant, was charged with the offense of Robbery with Firearms, in violation of 21 O.S.Supp.1973, § 801, and *1289was tried and convicted in the District Court, Oklahoma County, Case No. CRF-75-3989. Pursuant to the jury’s verdict, the defendant was sentenced to serve a term of five (5) years in the Oklahoma State Penitentiary. From said judgment and sentence, the defendant brings this appeal.

According to the evidence adduced at trial, the defendant entered LeBows Cleaners at 4:40 p. m. on October 16, 1975.…
