OPINION

BUSSEY, Judge:

Appellant, David L. Mathes, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Oklahoma County, Case No. CRF-74 — 5114, for the offense of Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor, Second and Subsequent Offense, in violation of 47 O.S.1971, § 11-902. His punishment was fixed at a term of five (5) years’ imprisonment and a fine in the amount of Seven Hundred and Fifty ($750.00) Dollars, and from said judgment and sentence a timely appeal has been perfected to this Court.
