NIX, Judge:

Plaintiff in error, Emmett Nathan Mee-kins, hereinafter referred to as the defendant, was charged in the District Court of Garfield County with the crime of Burglary Second Degree. He was tried by a jury, found guilty, and his punishment assessed at Two Years in the penitentiary. From that' judgment and sentence he has perfected his timely appeal to this Court alleging two propositions of error. -

The facts of the case, briefly, are that the Conoco Station belonging to Bob Siler, was burglarized and this was discovered at 6:30 A.M. on the morning of November 27, 1965, when Mr. Siler…
