Following trial, the jury returned a verdict of liability against defendant-appellant/cross-defendant-appellee, Touche Ross & Company (hereafter Touche Ross) in favor of plaintiff-appellee/cross-plaintiff-appellant, Congregation of the Passion, Holy Cross Province (hereafter Congregation), on count I, sounding in accounting malpractiee/negligence and assessed monetary damages in the amount of $3,900,000.
