SMITH, Acting Associate Justice.

This is an appeal from a judgment of the Supreme Court of the District of Columbia, sentencing the appellant, Charles Williams, to imprisonment for a period of five years in a penitentiary to be designated by the Attorney General.

It appears from the record that Williams was indicted on the 30th of December, 1922, and ehai’g'ed, first, with selling and dealing in narcotics between the 2d of Janizary, 1922, and the 5th of December, 1922, without registering his business with the collector of internal revenue and paying the special license tax prescribed therefor;…
