This is an appeal by the plaintiff from a judgment of the District Court of the United States for Puerto Rico dismissing Tiis complaint in an action for unpaid overtime compensation, liquidated damages, an attorney’s fee and costs brought under § 16 (b) of the Fair Labor Standards Act of 1938, 52 Stat. 1069, 29 U.S.C.A. § 216 (b).

In his complaint the plaintiff alleged that he was duly licensed by the Federal Communications Commission as a “Radio Telephone First Class Operator;” that from January, 1939, to July 31, 1940, he had worked for the defendant in the latter’s radio broadcasting…
