The defendant, an attorney and counselor at law, was elected a justice of the peace of the town of Oyster Bay in 1919 and re-elected in 1923. As justice of the peace he was also a member of the town board. While he was acting as justice of the peace and a member of the town board of Oyster Bay, his firm was appointed counsel to the commissioners of the Jericho water district and was paid as compensation for services performed as such counsel considerable sums of money out of the proceeds of bonds issued and sold by the town board of Oyster Bay to raise the amount of money which the…
