PROCEDURAL HISTORY
This matter is before the court by way of defendant’s Motion for Summary Judgment filed pursuant to Fed.R.Civ.P. 56(b). On October 19, 1984 the plaintiff filed a complaint against Defendant RCA Corporation (RCA) alleging three (3) common law causes of action. Jurisdiction was based upon diversity of citizenship as plaintiff is a Pennsylvania citizen and defendant a Delaware corporation.
