In this action an insurance company has obtained a judgment against its agent for sums charged against him in his capacity as such.

Designating the parties as they stood in the trial court, the plaintiff, American Mine Owners Casualty Corporation, is an insurance company engaged primarily in writing workmen’s compensation insurance for coal operators.
