In an action, inter alia, to recover damages for breach of a contract for the sale of real property, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Nassau County (Roncallo, J.), dated December 15, 1988, as denied its cross motion for partial summary judgment on the issue of liability.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the plaintiffs cross motion is granted to the extent that the defendants are directed to return the plaintiffs down payment, and the matter is remitted to the Supreme Court, Nassau…
