Prom Ripley Circuit Court; Francis M. Thompson, Judge. Action by 'William Federle, as guardian of Joseph Federle, a person of unsound mind, against tbe Cleveland, Cincinnati, Chicago and St. Louis Railway Company. From a judgment for plaintiff, the defendant appeals.

— Appellee brought this action to recover damages for injuries alleged to have been sustained by his ward on a public highway crossed by appellant’s road, and caused1 by the negligent construction of the approaches of said highway at said crossing.

The case was tried by a jury, which returned a verdict for appellee in the sum of $1,000, together with answers to interrogatories. Prom judgment in favor of appellee, this appeal was granted.
