We are first met with a motion of defendant in error to dismiss this appeal, which we have carefully considered, and feel must be denied.
The action is brought by the defendant in érror against Salina Colbert and others, including the unknown heirs of Allison Colbert, to partition the land described in the petition, asserting title to said land under a deed from J. S. Fulton, whom it averred acquired title from the heirs of Allison Colbert, deceased.
