Sharon Hayes (plaintiff) commenced this employment discrimination action against defendants Bernard Kerik, Commissioner, New York City Department of Corrections (the Commissioner) and the New York City Department of Corrections (the DOC), alleging violations of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e, et seq. (Title VII), and 42 U.S.C. § 1981, as well as a state law claim for intentional infliction of emotional harm.
