This motion is made by the defendant for an prder directing the district attorney of this county and the police *304commissioner of the city of New York to return to the defendant a certain revolver seized and taken from him as a result of an illegal search and seizure and enjoining the said district attorney and the said police commissioner from using the said revolver or any evidence or information derived from the said search and seizure against the defendant.
