This indemnification action stems from an automobile accident that occurred on October 18, 2004, involving Danielle Macready and Mikhail Kaplan. Danielle Macready was driving the 2004 Nissan Pathfinder (“Pathfinder”) that her parents, Donald Macready and Joann Delucie (the “Macreadys”), had leased from Bay Ridge Nissan Inc., when she collided with Kaplan, a 68-year-old bicyclist.
