Mandamus to Probate Judge, refusing to grant License for Retailing Spirituous Liquors. Appeal from the City Court of Montgomery. Tried before the Hon. Thos. M. Arrington. This cause originated in an application by A. Moog, to Hon. F. C. Randolph, judge of the Probate Court of Montgomery county, for a license to retail spirituous liquors within the corporate limits' of the city of Montgomery, for and during the year 1883, on the payment of $125 as the price of the license.

Since the decision of this court in the case of Jones v. Hutchinson, 43 Ala. 721, which was made at the June term, 1868, it may be regarded as a settled principle of law in this State, that the courts are authorized to search the records of the General Assembly, of which they are required to take judicial notice, so as to ascertain and declare whether a printed statute, purporting to be published under authority of the State, has, in truth and fact, been enacted according to the forms prescribed by the constitution.
