Petitioner DeShawn Adams appeals from the denial of his motion to vacate his sentence filed pursuant to 28 U.S.C. § 2255. In 2005 he pleaded guilty to a single count of conspiracy to distribute cocaine base, 21 U.S.C. § 846, and was sentenced to the statutory minimum of 120 months of incarceration. His statutory minimum sentence was increased from five to ten years based upon an acknowledgment that he had previously pleaded guilty in a Michigan court to the felony of attempting to possess less than 50 grams of a controlled substance.
