MEMORANDUM OPINION

ALBRITTON, Chief Judge.

I. INTRODUCTION

This cause is before the court on a Motion for Summary Judgment (Doc. # 8) filed by Defendants Patrick Manning, James Alexander, KM. Claunch, Phillip Pettus, and Joe Duncan, (collectively “the Defendants”) on July 9, 2002.

The Plaintiff, Michael Hill, originally filed his Complaint in this case on June 18, 2002. The Plaintiff brings claims for violation of procedural due process under 28 U.S.C. § 1983 (Count I), retaliation under the Fair Labor Standards Act (“FLSA”) (Count II), and assault (Count III).
