This case is presently pending before the court on defendant’s Amended Motion to Dismiss, (doc. 6),1 and plaintiffs’ Motion to Strike, (doc. 13). Defendant moves for dismissal of this action, in its entirety, for: (1) lack of subject matter jurisdiction; (2) lack of personal jurisdiction; (3) improper venue; (4) failure to state a claim upon which relief can be granted; and (5) failure to join an indispensable party.
