By two issues, Dominic McKaine challenges his conviction and sentence for burglary of a habitation and committing aggravated assault therein. 1 The Court’s original opinion in this case reversed the trial court’s judgment and remanded the case to the trial court for a new punishment hearing. McKaine v. State, No. 13-03-00430-CR, 2004 WL 905562, 2004 Tex. App. LEXIS 3777 (Tex.App.-Corpus Christi, April 29, 2004, no pet. h.).
