NATURE OF THE CASE
Appellant, Joseph P. Arnzen (“Arnzen”), appeals from the summary judgment of the district court. In granting summary judgment, the district court dismissed two 42 U.S.C. § 1983 claims against respondents State of Idaho (“State”) and Mack W. Richardson (“Richardson”) in his official capacity as Director of the Department of Law Enforcement (“Department”). The court dismissed these claims finding that neither respondent was a “person” as that word is used in 42 U.S.C. § 1983.
