Error to a judgment of the Circuit Court of Culpeper county in an action of trespass on the case. Judgment for the defendants. Plaintiff assigns error.

George E. Tanner, the plaintiff in error, brought an action against the defendants in error, the town of Culpeper and the Culpeper Construction Company, to recover damages for personal injuries to him caused by the alleged negligence of the defendants. The negligence averred consisted in this, that for many weeks prior to his injury on the 21st day of February, 1913, the defendants had negligently and knowingly stored, located and maintained upon Main street, a public highway in said town, a large steam roller, weighing about ten tons, so as to occupy a considerable part of the street,…
