DAVIDSON, Presiding Judge.
This conviction was for murder in the second degree, the punishment being assessed at ten years confinement in the penitentiary.
The tragedy occurred in the reception room or'office of a hotel in Knox City, Baylor County, on the night of the day on which the election was held, resulting in the election of what is known as the Bailey ticket over the Johnson ticket, for the selection of delegates to the National Democratic Convention.
